Employer of Record services (EOR, sometimes called Professional Employer Organisation PEO)

What is an Employer of Record service?

An Employer of Record (EOR) service is where a local properly constituted company in a country employs staff on behalf of our clients. It means that a client can have staff without the cost and commitment of setting up a legal entity.

When using an Employer of Record, the client still

  • Recruits/Chooses the employee(s),
  • Sets the job title,
  • Decides the salary, and benefits
  • Decides whether the employment is fixed term or indefinite,
  • Sets objectives and judges performance
  • Grants bonuses, commission and promotions,
  • Agrees vacations and absence
  • Authorizes expenses.

In an Employer of Record service, the role of Le Cheminant and its partners is to…

  • Issue employment contracts and ensure signatures
  • Monitor probationary periods and confirm regular employment
  • Receive the client’s instructions and payroll the employees including calculation and payment of taxes and social security.
  • Pay the employee on time, including expenses
  • Ensure benefits administration.

1Can we specify particular employee benefits Are there any employee benefits included?
Mandatory benefits are included and YES, we can provide specific extra benefits but there are occasions in certain countries where if a benefit is given to one employee it must be given to all. But we usually manage to solve these problems.
2Are there minimum employee commitments?
No, we will happily employ just one person in all countries.
3Is the employment of Expats possible by Employer of Record companies?

4How long does it take?
Answer: Providing data flows smoothly we can set up employment in 1-2 weeks.
5Can the employment be backdated?
Yes, backdating employment start dates is possible in some countries, but if there are restrictions, we will nevertheless find a solution
6Can we customize the employment contract?
Yes, but the employment contracts have been vetted by legal advisors and so if there are extensive changes this may involve further legal advice. It is often easier to write a separate letter rather than amend the contract.
7Do you support contractors as well as employees?
YES, and we provide a service where we pay contractors and consultants, so the client has a certain “distance” from the consultant avoiding any claims of “disguised employment”.
